MDLPA-certified technical expert
Af technical expert assessment of geotechnical structures and deep excavations
Rigorous technical assessments by certified experts of the stability of earth masses and of soil-structure interaction, establishing whether foundation solutions meet the basic requirement of mechanical resistance and stability under Law no. 169/2026 (the Romanian Code of Spatial Planning, Urbanism and Construction) and the design standards.
In Romanian law
What a technical expert assessment (expertiză tehnică) is
A statutory technical assessment of an existing structure, or of a design, written and signed by an expert certified by MDLPA for the relevant field. For the ground, the field is Af: strength and stability of the foundation ground and of earth masses. The assessment is the basis for intervention works, permits for building next to existing structures, regularisation permits and disputes.
Types of assessment
What the Af expert assessment covers
Existing geotechnical structures
Af technical expert assessments of existing geotechnical structures.
Deep excavations
Expert assessments of deep excavations, under NP 120:2014.
NP 120:2014Stability of earth masses
Expert assessments of the stability of earth masses.
Out-of-court expert reports
Out-of-court expert reports, as party-appointed or independent expert.
When it is needed
Situations that call for an Af expert assessment
- Intervention works on existing buildings. The design must be based on technical expert assessments by experts certified for the relevant basic requirements (art. 285 and art. 438, Law 169/2026).
- New building next to an existing one. The measures to make neighbouring buildings safe, identified through a technical expert assessment, require the neighbours' consent in notarised form (art. 261).
- Regularisation permit. Buildings erected without a permit, or not in line with it, can be regularised only if they meet the basic requirements, proven through technical expert assessments (art. 301).
- Cracks, settlement or sliding of an existing geotechnical structure, cut slope or natural slope.
- Disputes that require an out-of-court expert report, as party-appointed or independent expert.
Legal framework
Technical expert assessment under Law no. 169/2026
Since 25 August 2026, technical expert assessment is governed by the Code of Spatial Planning, Urbanism and Construction (art. 435–439). The regulation approved by Government Decision no. 925/1995 remains in force until it is amended.
Independence
The assessment cannot be written by the party that prepared or checked the design.
Traceability
A summary of the report is entered in the National Construction Register, and assessments of existing buildings are recorded in the building's technical logbook (art. 437).
Insured liability
The certified technical expert must hold professional liability insurance (art. 439).
